1. E-mail from Charlie at KYFM:
The following e-mail is a reply I got from Charlie at KYFM stating that he was not familiar with our artist and song. This was the first e-mail that sparked my interest to further investigate the validity of Howard Rosen Promotion, Inc's. reports with the other stations that were listed on the reports. You will find their replies continued on the page as well. On the next page after this, I have provided replies that came from the three audio fingerprinting companies that I registered our artist's music with.

NOTE: According to Howard Rosen Promotion, Inc's. reports, Charlie's station (KYFM) added our artist's song to their playlist on the week of March 7th, 2007 and played it 95 times to the date of this e-mail. Charlie's response proves the opposite of Howard Rosen Promotion, Inc's. reports.

2. E-mail from Joey at KKHJ:
The following e-mail correspondence is from Joey at KKHJ stating that he never heard of our artist and has never played our artist's song on their radio station.

NOTE: According to Howard Rosen Promotion, Inc's. reports, KKHJ added our artist's song to their playlist on the week of March 28th, 2007 and played it 75 times to the date of Joey's e-mail. Joey's response proves the opposite of Howard Rosen Promotion, Inc's. reports.

Clarence,

Herein lies my sworn testimony (I am typing with one hand on the Bible) regarding the subject of music played on KKHJ-FM.

I am in charge of everything that happens on my station and I have never heard of that record. I am unaware of any recording by the band Chameleo, nor have I played any song by said band on the airwaves of KKHJ-FM. Ever.

As I told you on the phone earlier, KKHJ-FM operates a Hot AC format designed to bring current hits to the island of American Samoa. We don't play "up and coming" bands. If it's not already at the top of the charts, we don't play it.

Great talking with you just now… Thanks for your help with this.

If I could just get in writing what we talked about that would be great. If you can include what you told me about your format, on how you only play the already charting singles from the states, then that would be wonderful.

By the way, just for your info, our promotion for Chameleo’s single “It’s Okay” started on 2/19/2007 and ended on 5/2/2007.

You pretty much said what everybody else has told me (the promoter, if you can even call him that, is just in it for the money).

I am CC’ing a copy to Larry and attaching his response I got a while ago, just to refresh on what our communication was.

Thanks again for the time you guys have taken to help us with this and I will let you know if we win the case in September,
