EVIDENCE OF FALSE AIRPLAY REPORTING:
In 2007, we hired Howard Rosen Promotion, Inc. to promote an artist's music single to radio. The reports we received from Howard Rosen Promotion, Inc. claimed that the single received 611 spins across 20 stations over a 10 week period. Using our digital audio fingerprints registered through Nielsen/BDS, Mediaguide, and Mediabase confirmed only ONE spin on ONE station over the 10 week period for stations covered by these companies. Furthermore, these companies confirmed that there were 191 false spins reported by Howard Rosen Promotion, Inc.

In our research of e-mail and phone conversations we confirmed 60 false spins and received a sworn testimony verifying this. We also contacted a station Phone and Email Research monitored by Mediaguide and the station testified that they were not playing the song either with a total of 140 false spins. 41% of the reports are falsified with a total of 251 false spins, and that is just the stations we got around to contacting and monitoring. We did find a few stations that were actually playing the song with a total of 48 true spins but who is to say what our research would find if we contacted the additional 13 stations who aren't monitored and never received correspondence from us?

When we called the radio stations that, according to Howard Rosen Promotion, Inc's. reports, were spinning the single, most of the stations had never heard of our artist and told us they weren't playing the single on their radio station either! We have several sworn testimonies from these station program directors, music directors, and general managers to this effect.
